5. Purposes and legal basis of processing

a) Visiting the website

When you visit our website, your data will be evaluated in accordance with Art. 6 para. 1 lit. f) EU GDPR to optimize the website and used to ensure system and network security or for technical administration purposes. We have a legitimate interest in using the data you provide below to ensure the security of our systems.

IP addresses
When you visit our website, the web server stores the so-called IP address of your computer for a short period of time, which enables a clear assignment and thus the accessibility of the computer and the provision of the website in the first place. The IP address is an individual "address" of a computer in a computer network. This means that you can use our website at any time without having to disclose your data.

Log data
When you visit our website, the following data is stored in a log file for a maximum of one month: 

  • the website from which you visit us,
  • the websites you visit on our site,
  • the time of your visit to our website,
  • the browser type and version,
  • your IP address

We evaluate the data anonymously for statistical purposes and to improve our website. This data does not allow any conclusions to be drawn about you. We store the analyzed data on secure systems. This ensures that your privacy is protected at all times.

Our website uses session cookies, i.e. only a session number is stored. Session cookies are automatically deleted by the browser after the browser is closed. You can prevent the installation of cookies by selecting the appropriate settings in your browser software.

b) Contact by the user 

Contact can be made by e-mail, a contact form on the website, letter, telephone, fax or otherwise. If you contact us, we will use the information you provide to process your request. If necessary, your data and information will also be passed on within the LBBW Immobilien Group in order to process your request properly. The data will not be passed on to other third parties without your consent. In all these cases, you provide us with your data voluntarily. The data will not be used for purposes other than those you have specified.

This website uses JavaScript, a scripting language used to dynamically design web pages and add various functionalities. d) Customers, business partners, applicants and other affected persons

If you have purchased a flat from us as a private individual, for example, we process your data as a customer in accordance with Art. 6 para. 1 lit. b) EU GDPR for the fulfilment of the contract. The data includes, for example, address and contract data or data from correspondence with you. If you are a commercial customer, we also process the contact data of your employees provided by you in addition to the contract data. If necessary, your data will be passed on to third parties commissioned by us to fulfil our contractual obligations (e.g. estate agents, tradesmen, engineering firms, etc.). We will delete your data as soon as it is no longer required and there are no legal obligations to retain it.

If you have purchased an apartment from us as a private individual, for example, we process your data as a customer in accordance with Art. 6 para. 1 lit. b) EU GDPR to fulfill the contract. The data includes, for example, address and contract data or data from correspondence with you. If you are a commercial customer, we also process the contact data of your employees provided by you in addition to the contract data. If necessary, your data will be passed on to third parties commissioned by us to fulfill our contractual obligations (e.g. brokers, craftsmen, engineering offices, etc.). We will delete your data as soon as it is no longer required and there are no legal obligations to retain it.

If you are a tenant of a property built and sold by us, but are not in a contractual relationship with us, we will only use your data in accordance with Art. 6 para. 1 lit. a) EU GDPR if you have consented to this, e.g. to process your inquiries. You can revoke your consent at any time by sending us a message by post or to datenschutz@lbbw-im.de. We will then delete your data. Please note, however, that we will then no longer be able to contact you or assist you in rectifying any defects. You must contact your landlord directly for this.

If you are our business partner, we process your data in order to contact you, to process inquiries or to fulfill contractual obligations in accordance with Art. 6 para. 1 lit. b) EU GDPR.

In accordance with legal requirements such as EU regulations on sanctions and embargo list checks, the Money Laundering Act or other control and reporting obligations, we process your data in accordance with Art. 6 para. 1 lit. c GDPR, e.g. for the purpose of identity verification, fraud or money laundering prevention.

We will not pass on your data to third parties outside the LBBW Immobilien Group without your consent. Data will only be passed on within the LBBW Immobilien Group if this is necessary.

We will delete your data as soon as it is no longer required and the deletion does not conflict with any retention obligations.

 a) Collection and storage of personal data as well as type and purpose and their use 

If you subscribe to a fund with KVG Hansa Invest for which we are mandated as investment advisor, we process the following information:

  • Name and address of the investor
  • Title, first name, surname of the representative and contact person
  • a valid e-mail address
  • Telephone number (landline and/or mobile)
  • Fund number, subscription amount

This data is collected,

  • to be able to identify you as an investor;
  • to be able to advise and represent the KVG;
  • for correspondence with the KVG and you.

Data processing is carried out on the basis of existing contracts between you and the KVG and between us and the KVG within the scope of the tasks we have assumed and is necessary for the purposes mentioned for the appropriate processing of contractual obligations in accordance with Section 6 (1) (b) EU GDPR.

The data regularly originates directly from you or is transmitted to us by the KVG. We will store this data until the end of the contractual relationship and then delete it, unless we are obliged to store it for longer in accordance with Article 6 (1) sentence 1 lit. c GDPR due to tax and commercial law storage and documentation obligations (from HGB, StGB or AO) or you have consented to further storage in accordance with Article 6 (1) sentence 1 lit. a GDPR. 

b) Disclosure of data to third parties 

Your personal data will not be transferred to third parties for purposes other than those listed below.

Insofar as this is necessary for the fulfillment of contractual obligations in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR, your personal data will be passed on to third parties. This includes in particular the transfer to 

  • financing banks to review their legal obligations, particularly those arising from the German Banking Act (KWG) and the Capital Requirements Regulation (CRR);
  • other service providers as part of their support to us, e.g. LBBW Immobilien Management GmbH (as part of their activities in compliance checks, search for financing options, etc.)

and their representatives.

The data passed on may only be used by the third parties for the stated purposes.

e) Data protection information for online meetings, telephone conferences and webinars via "GoToMeeting" of the LBBW Immobilien Group

We would like to inform you below about the processing of personal data in connection with the use of "GoToMeeting".

ea) Purpose of the processing

We use the "GoToMeeting" tool to conduct telephone conferences, online meetings, video conferences and/or webinars (hereinafter: "Online Meetings"). "GoToMeeting" is a service provided by LogMeIn Ireland Limited.

eb) Responsible corporation

The controller for data processing directly related to the holding of "online meetings" is the respective inviting company of the LBBW Immobilien Group.

Note: If you access the "GoToMeeting" website, the provider of "GoToMeeting" is responsible for data processing. However, accessing the website is only necessary for the use of "GoToMeeting" in order to download the software for the use of "GoToMeeting".

If you do not want to or cannot use the "GoToMeeting" app, the basic functions can also be used via a browser version, which you can also find on the "GoToMeeting" website.

ec) What data is processed?

When using "GoToMeeting", various categories of personal data are processed. The scope depends on the information you provide before or during participation in an "online meeting".

The following categories are subject to processing:

User details: Display name, e-mail address (optional), profile picture (optional), preferred language

Meeting metadata: Meeting ID, participant IP addresses, telephone numbers, location

Text, audio and video data: You may have the option of using the chat function in an "online meeting". In this respect, the text entries you make are processed in order to display them in the "online meeting". In order to enable the display of video and the playback of audio, the data from the microphone of your end device and from any video camera of the end device will be processed accordingly for the duration of the meeting. You can switch off or mute the camera or microphone yourself at any time via the "GoToMeeting" applications.

ed) Scope of the processing

We use "GoToMeeting" to conduct "online meetings". Recordings are administratively prevented and are therefore not possible or permitted.

Automated decision-making within the meaning of Art. 22 GDPR is not used.

ee) Legal basis for data processing

Insofar as personal data of employees of the LBBW Immobilien Group is processed, Section 26 BDSG is the legal basis for data processing. If, in connection with the use of "GoToMeeting", personal data is not required for the establishment, implementation or termination of the employment relationship, but is nevertheless an elementary component of the use of "GoToMeeting", Art. 6 para. 1 lit. f) GDPR is the legal basis for data processing. In these cases, we are interested in the effective conduct of online meetings.

Otherwise, the legal basis for data processing when conducting "online meetings" is Art. 6 para. 1 lit. b) GDPR, insofar as the meetings are conducted within the framework of contractual relationships.

If there is no contractual relationship, the legal basis is Art. 6 para. 1 lit. f) GDPR. Here, we have an interest in the effective conduct of online meetings. There are no indications that conflicting interests of the data subjects prevail due to the business use, the regularly voluntary participation of the participants, the tangential content of the meetings and the information of all participants in the meetings.

ef) Recipients / forwarding of data

Personal data that is processed in connection with participation in "online meetings" is not passed on to third parties unless it is intended to be passed on. Please note that content from "online meetings", as with face-to-face meetings, is often used to communicate information with customers, interested parties or third parties and is therefore intended to be passed on.

Other recipients: The provider of "GoToMeeting" necessarily receives knowledge of the above-mentioned data, insofar as this is provided for in our order processing contract with "GoToMeeting".

eg) Data processing outside the European Union

Data may be processed outside the European Union (EU). The transfer of data is permitted for the following reasons:

It cannot be ruled out that the recipient of data is also the parent company of the provider of "GoToMeeting", i.e. the American company LogMeIn Inc.

An examination of the provider on the basis of the documents provided has shown that the requirements of the GDPR are complied with and thus an adequate level of protection exists. This is additionally contractually guaranteed by the conclusion of EU standard contractual clauses.

However, the data is encrypted during transport via the Internet and thus protected against unauthorized access by third parties.

eh) Deletion of data

We generally delete personal data when there is no need for further storage. A requirement may exist in particular if the data is still needed to fulfill contractual services, to check and grant or defend against warranty and guarantee claims. In the case of statutory retention obligations, deletion will only be considered after the respective retention obligation has expired.

6. Other information

a) Recipients or categories of recipients to whom the data may be disclosed

The LBBW Immobilien Group consists of various companies. Within the Group, tasks are primarily performed by one company in each case (e.g. in the areas of human resources, legal, tax, controlling, IT, etc.).

To fulfill the respective tasks, data is exchanged within the LBBW Immobilien Group for specific purposes where necessary.

Personal data is only transferred to state institutions and authorities within the framework of mandatory legal provisions or if the transfer is necessary. Data will only be transferred to other third parties with your consent.

In addition, the data will be forwarded to project participants, such as engineering firms, tradesmen, brokers, etc., to fulfill our contractual obligations or to fulfill your inquiries.

b) Security in data processing

We ensure a high level of security when we collect or process your data. We use effective technical and organizational measures for this purpose. This enables us to protect your data against manipulation, loss, destruction or access by unauthorized persons. We are constantly improving our security measures and adapting them to technological developments.

c) Deletion periods

The processed data will be deleted after the final response to your request or after the contract concluded with you has expired, unless there are statutory retention periods.

d) Data transfer to other EU countries

No data is transferred to countries outside the EU.

7. your rights

In accordance with Art. 15 GDPR, you have the right to request information about your personal data processed by us. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information about its details.

In accordance with Art. 16 GDPR, you have the right to demand the immediate correction of incorrect or incomplete personal data stored by us.

In accordance with Art. 17 GDPR, you have the right to request the deletion of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.

In accordance with Art. 18 GDPR, you have the right to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR.

In accordance with Art. 20 GDPR, you have the right to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transferred to another controller.

You have the right to withdraw your consent at any time in accordance with Art. 7 (3) GDPR. As a result, we may no longer continue the data processing that was based on this consent in the future.

You have the right to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR (see address above).

If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right to object, which will be implemented by us without specifying a particular situation.

a) external links

Our Internet pages may contain links to Internet pages of third parties - providers not affiliated with us. After clicking on the link, we no longer have any influence on the processing of your data (e.g. the IP address or the URL of the page on which the link is located), which is transferred to the third party when you click on the link. We accept no responsibility for the content of the linked page or for the processing of data by third parties.

b) Innovations

The rapid development of the Internet makes it necessary to adapt our privacy policy from time to time. On this page we will inform you about the respective changes. We recommend that you check our pages regularly for changes. This way you can be sure that you are always correctly informed. All changes to the privacy policy only apply to future application. We will not change the guidelines retroactively, unless required by law.

c) Data security

We use the widespread SSL (Secure Socket Layer) method in conjunction with the highest level of encryption supported by your browser when you visit our website. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.
We also use suitable technical and organizational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorized access by third parties.
